California Job Applicant and Independent Contractor Privacy Notice

UNS Energy Corporation and its subsidiaries, including Tucson Electric Power Company ("TEP") and UniSource Energy Services, Inc. ("UES"), are committed to respecting the privacy of your personal information. For purposes of this California Job Applicant and Independent Contractor Notice ("Notice"), UNS Energy Corporation and its subsidiaries may be collectively referred to as the "Company".

Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 job applicants and contractors who are California residents have the right to be informed as to the categories of personal information collected about them and the purposes for which the information will be used. The Company does not sell the personal information of job applicants or independent contractors, including for targeted advertising.

Additionally, California resident rights are described in the Supplemental Privacy Notice in the TEP and UES Privacy Policies located at www.tep.com/privacy and www.uesaz.com/privacy, respectively.

Job Applicants

The Company may collect personal information about you directly from you, whether by phone, mail, text, email, and through job application websites. This includes personal information contained in your resume, cover letter, job application, interview notes, school transcripts and any required background checks or drug screens should the Company extend an offer of employment to you. This Notice describes the categories of personal information that the Company collects from or about you when you apply for a job with the Company and the purposes for which the Company intends to use this information:

  • Identifying information, such as your full name, gender, date of birth, and signature.
  • Demographic data, such as race, ethnic origin, marital status, disability, and veteran or military status.
  • Contact information, such as your home address, telephone numbers, and email addresses.
  • Educational and professional background, such as your work history, academic and professional qualifications, educational records, references, and interview notes.
  • Employment details, such as your current and former job titles, hire dates, and compensation,
  • Health and Safety information, such as health conditions (if relevant to your employment) and job restrictions, if any.

The Company collects personal information of job applicants to use or disclose as appropriate to:

  • comply with all applicable laws and regulations.
  • recruit and evaluate job applicants and candidates for employment.
  • If you are hired, the Company may use your personal information to manage your employment relationship with the Company, including for the following purposes:
    • conducting background checks;
    • onboarding processes;
    • timekeeping, payroll, and expense report administration;
    • verifying your eligibility to work in the United States;
    • employee benefits administration;
    • employee training and development requirements;
    • the creation, maintenance, and security of your online employee accounts;
    • reaching your emergency contacts when needed, such as when you are not reachable or are injured or ill;
    • workers' compensation claims management;
    • employee job performance, including goals and performance reviews, promotions, discipline, and termination; and
    • other human resources purposes.
    • Manage and monitor employee access to Company facilities, equipment, and systems.
    • Conduct internal audits and workplace investigations.
    • Investigate and enforce compliance with and potential breaches of Company policies and procedures.
    • Engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions involving the Company.
    • Maintain commercial insurance policies and coverages, including for workers' compensation and other liability insurance.
    • Perform workforce analytics, data analytics, and benchmarking.
    • Administer and maintain the Company's operations, including for safety purposes.
    • Exercise or defend the legal rights of the Company.

Retention

Subject to limits imposed by applicable law, the Company retains information as long as you remain employed by the Company and then for any additional time that will be useful to fulfill a disclosed business purpose, legal requirement or law enforcement need. With respect to persons who applied to the Company but were not ultimately not employed, the Company will maintain your information for such time as will be useful to fulfill a disclosed business purpose, legal requirement or law enforcement need. The Company uses secure disposal methods when information is no longer needed.

Independent Contractors

The Company may collect personal information about you directly from you, whether by phone, mail, text, email, and through our independent contractor onboarding forms and processes, including completion of our Supplier Fact Sheet. This Notice describes the categories of personal information that the Company collects from or about you when you apply to work for the Company and the purposes for which the Company intends to use this information:

  • Identifying information, such as your full name, gender, and signature.
  • Demographic data, such as disability, and veteran or military status.
  • Contact information, such as your address, telephone numbers, and email addresses.
  • Educational and professional background, such as your work history, job title contracting history, academic and professional qualifications, educational records, references, and interview notes.
  • Financial details, such as your banking details and tax information.
  • Health and Safety information, such workplace illness and injury information, including with respect to COVID-19 (if relevant to your contract with the Company).
  • Information Systems Information, such as your search and browsing history, login information and IP address while on Company’s assets and networks.
  • Surveillance Information, such as when you "badge in" to access Company facilities and information collected from video surveillance systems in use on Company property.

The Company collects personal information of Independent Contractors to use or disclose as appropriate to:

  • comply with all applicable laws and regulations.
  • evaluate independent contractors in deciding to engage in their services.
  • manage your contracting relationship with the Company, including for the following purposes:
    • payment administration;
    • onboarding processes;
    • the creation, maintenance and security of your online accounts;
    • verifying your eligibility to work in the United States;
    • manage and monitor your access to Company facilities, equipment, and systems;
    • conduct internal audits and investigations;
    • investigate and enforce compliance with and potential breaches of Company policies and procedures;
    • engage in corporate transactions requiring review of independent contractor records, such as for evaluating potential mergers and acquisitions involving the Company;
    • administer and maintain the Company's operations, including for safety purposes; and
    • exercise or defend the legal rights of the Company, and its employees, customers, contractors, and agents.

Retention

Subject to limits imposed by applicable law, the Company retains information as long as you remain engaged as an independent contractor by the Company and then for any additional time that will be useful to fulfill a disclosed business purpose, legal requirement or law enforcement need. With respect to persons who enter into discussions or negotiations with the Company but are not engaged as independent contractors, the Company will maintain your information for such time as will be useful to fulfill a disclosed business purpose, legal requirement or law enforcement need. The Company uses secure disposal methods when information is no longer needed.
