E-bike Sweepstakes Official Rules

SPONSOR: Tucson Electric Power Company, 88 E. Broadway Blvd., Tucson, Arizona 85701

WHO MAY ENTER: This Sweepstakes is open to Tucson Electric Power Company (“TEP”) account holders who are U.S. residents 18 years of age or older. As used in this Sweepstakes, “TEP account holder” is defined as a natural person who holds a residential account for electric service with TEP. The following persons are not eligible to enter: (a) employees of TEP, its affiliates, subsidiaries, officers or employees and (b) immediate family members and persons living in the same household as the persons identified in (a) above. This Sweepstakes is valid only in Arizona and void in New York and Florida and where otherwise prohibited or restricted by law.

HOW TO ENTER: To enter, complete the electronic survey between 9:00 AM Mountain Standard Time (MST) October 27, 2023, and October 30, 2023 at 9:00 AM Mountain Standard Time (MST) which is the “Sweepstakes Period.” For purposes of these Sweepstakes, “receipt” of an internet entry occurs when TEP’s servers record the entry information resulting from the entrant clicking the “Submit Entry” button. You may also send a mail-in entry to Tucson Electric Power Company, Attn. Camila Martins-Bekat, 88 East Broadway, Tucson, AZ, 85701 and which must be postmarked no later than October 30, 2023, during the Sweepstakes Period. Fill out a 3x5 postcard with your name, address (including zip code), home and work telephone numbers (including area codes) and TEP account number and mail postage paid to the address listed above. All mailed entries must be received by November 6, 2023. All entries become the property of TEP and will not be returned. The winner must meet the eligibility requirements set forth in these rules in order to qualify for the prize. Limit one entry per TEP account holder. TEP is not responsible for lost, late, misdirected, incomplete or illegible entries whether sent by post or over the internet.

ODDS OF WINNING: Based upon the estimated number of entries to be received, the odds of winning are approximately 1 in 1,000. The actual odds of winning will depend upon the actual number of eligible entries received during the Sweepstakes Period.

RANDOM DRAWING/ WINNER NOTIFICATION: There will be one (1) winner. Winner will be selected in random drawings on November 11, 2023.from among all eligible entries received. Winner will be notified by phone and email by 5 pm on November 13, 2023. The list of winners can be obtained by contacting cmartins-bekat@tep.com

PRIZES: One all-electric bike. Only this specified prize will be awarded. Prize is non-transferable. All federal, state and local income taxes connected to the prize are the sole responsibility of the winner. All federal, state and local laws and regulations apply.

CLAIMING PRIZE: All properly claimed prizes will be awarded. As a condition of winning a prize, the potential winner must complete, sign and return an affidavit of eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority, including, without limitation, an IRS Form W-9, within ten (10) days of receipt of prize notification or prizes will be forfeited and an alternate winner selected. Further, by accepting the prize, the winner consents to TEP’s use of their name, photograph and/or likeness, voice and statements made by or attributed to them as part of the Sweepstakes, in perpetuity, in any and all media for all legitimate business purposes, including advertising and promotional activities, without additional compensation, unless prohibited by law.

If the prize is unclaimed within ten (10) days of the date that TEP notifies the potential winner, including by voicemail, or if a potential winner is disqualified for any reason, the prize will be forfeited and awarded to an alternate winner. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to TEP their prize. Any unclaimed prizes will be awarded in a random drawing from all remaining eligible entries to be held if necessary.

Any potential winner may be requested to provide TEP with proof that such winner is the authorized TEP account holder associated with the winning entry.

Prize can be picked up at Fair Wheel Bikes, 1110 E. Sixth St, Tucson AZ 85719. E-bike must be picked up by Nov. 27, 2023.

PRIVACY: TEP will be collecting personal data about entrants in accordance with its privacy policy. Please review TEP’s privacy policy at www.tep.com/privacy. By participating in the Sweepstakes, you hereby agree to TEP’s collection and usage of your personal information and acknowledge that you have read and accepted TEP’s privacy policy.

LIMITATION OF LIABILITY: By participating in this Sweepstakes, entrants agree to release and hold harmless TEP, its affiliates, subsidiaries and their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) from any and all liability whatsoever for losses or damages of any kind arising from or in connection with, either directly or indirectly, the awarding, acceptance, receipt, possession or use of any prize awarded herein, and/or participation in the Sweepstakes. Upon delivery of the prize to the winner, TEP will be deemed to have awarded the prize to the winner with the winner assuming full responsibility for their prize. Released Parties are not responsible for technical, hardware, software or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, internet, or ISP availability, unauthorized human intervention, congestion, incomplete or inaccurate entry information, or failed, incomplete, or delayed computer transmissions or delays with the United States post office which may limit or prohibit one’s ability to enter the Sweepstakes, including any injury or damage to any person’s computer relating to or resulting from participating in this Sweepstakes. Under no circumstances will entrants be entitled to, and hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees.

MISCELLANEOUS CONDITIONS: If, for any reason, the Sweepstakes is not capable of running as planned, including because of computer virus, tampering, hacking, fraud, technical failures or any other cause beyond the control of TEP, TEP reserves the right in its sole discretion to terminate, modify or suspend the Sweepstakes and select a winner from among all eligible entries prior to the termination. Persons found or believed to be tampering with or abusing any aspect of this Sweepstakes will be disqualified. TEP reserves the right to correct any typographical, printing, computer programming or operator errors.

CHOICE OF LAW: The construction, validity, interpretation and enforceability of these Official Rules and this Sweepstakes shall be governed by the laws of the State of Arizona, without regard to the conflict of law principles thereof.
