TEP 2024 AI Art Contest
Official Rules
The terms and conditions set forth below form the official rules (the “Official Rules”) governing the digital “TEP AI Monsoon Art Contest” contest (the “AI Art Contest”) sponsored by Tucson Electric Power Company (“TEP”). This is a skill-based contest and chance pays no part in the determination of Art Contest winners.
Description of Art Contest Objectives. Artificial Intelligence is experiencing rapid growth as it influences our culture. Show us the best rendering of Tucson monsoons. Clouds, rain, lightning, hazy mountains and sunsets – they all make monsoon storms beautiful. Incorporate them into an AI-generated submission that showcases the unique desert environment we call home. If your submission receives the most votes, you will receive a TEP prize package. Please do not submit any original artwork unless created using artificial intelligence. In the unlikely event that two submissions are identical, we will accept the version first submitted.
Sponsor. This AI Art Contest is sponsored by TEP, at 88 E. Broadway Blvd., Tucson, Arizona 85701. It is in no way sponsored, endorsed, administered by, or associated with, Facebook, Twitter/X or Instagram. TEP’s decisions are final and binding on all matters related to this AI Art Contest.
Agreement to Abide By Official Rules. By submitting an entry to the AI Art Contest, you indicate your full and unconditional agreement to and acceptance of these Official Rules and certify that your entry will strictly comply with all requirements set forth in these Official Rules. You are reminded that, by participating in this AI Art Contest and sharing content to Facebook, Twitter/X or Instagram, you are bound by those channels’ Terms of Service.
Eligibility. The AI Art Contest is open exclusively to TEP customers who are 18 years of age or older and legal residents of the United States. Employees of TEP as well as the immediate family (spouse, parents, siblings, and children) and household members of employees are not eligible to enter. This AI Art Contest is valid only in Arizona. TEP reserves the right to review the eligibility of the potential winner before any prizes are awarded.
Entry Period. The Art Contest begins at 6 a.m. MST on July 5, 2024 and ends at 3 p.m. MST on August 11, 2024 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. TEP’s computer is the official time-keeping device for the AI Art Contest.
How to Enter. Complete the required fields at https://tep.jotform.com/241704635376055 and upload your AI-generated submission. You may also enter by uploading your submission to Facebook, Twitter/X or Instagram with the hashtag #TucsonAIMonsoonArt. Only one entry is allowed, regardless of method of entry. Watermarked photos are not eligible for entry. All entries should reflect storms in the greater Pima County area. All entries will be pre-screened to ensure compliance with the Official Rules before they will appear in the AI Art Contest gallery.
Entries must:
- Cite which generative AI tool was used and what output was created.
- By entering this AI Art Contest, you represent and warrant that your entry was created using generative AI and an original prompt developed by you and to the best of your knowledge does not infringe a third-party’s intellectual property rights.
- Be suitable for public disclosure and not contain material that is obscene or offensive.
- Not include any real person or people who are identifiable.
- Not contain any material that could reflect negatively on the name, reputation, or goodwill of TEP, its parent companies, subsidiaries or affiliates.
- Not include sculptures, artwork or other copyrighted materials owned by others.
- Not depict an unsafe situation such as people or vehicles around downed power lines.
TEP reserves the right to reject and remove any entries at TEP’s sole discretion, to include a lack of compliance with the Official Rules.
Winner Selection. Winners will be determined by public voting. All entries will be eligible for voting unless TEP removes them for non-compliance with the Official Rules. Voting is open to the general public. An individual can vote for one entry per day during the voting period of August 12 – 16, 2024. One winner will be selected based on the highest number of votes. In the event of a tie, TEP will select the winner based on the quality of the submission. Only one prize will be award. The winner will be notified within five (5) days of winning via email or phone, if provided. If the winner entered through https://tep.jotform.com/241704635376055 the notification will be provided by email. The winner must verify eligibility with their TEP account number and/or service address and provide TEP a mailing address to receive the prize.
Odds of Winning. The odds of winning depend on the total number of eligible entries received and the skill of the entrant.
Prizes. Subject to these Official Rules, TEP will award one prize package that includes a $100 gift certificate to the TEP Marketplace, a $100 Visa gift certificate and a variety of energy efficiency and TEP-branded products. The prize package is valued at approximately $200. One prize package will be awarded. No cash or other substitution of the prize is permitted, except that TEP reserves the right to substitute the prize with another prize of equal or greater value if the prize is not available for any reason, as determined by TEP in its sole discretion. The prize winner is solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to the prize and for any costs and expenses incurred to claim the prize. The prize is offered “as is” with no written, express, or implied warranty.
Notification and Requirements of Potential Winners. The winner will be notified by email if they entered on https://tep.jotform.com/241704635376055. If the winner entered via Facebook, Twitter/X or Instagram, they will be notified via those channels. The winner must respond within 72 hours or the prize will be forfeited and another winner will be selected. TEP shall have no liability for the winner’s failure to receive notices due to spam, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information. Failure to sign and deliver any documents required by TEP to distribute the prize may result is disqualification from the AI Art Contest and selection of an alternate winner. If a potential winner is not eligible or is not in compliance with these Official Rules, if the prize notification is returned as undeliverable, or if the prize is rejected, the potential winner will be disqualified and the prize will be forfeited and may be awarded to an alternate winner. TEP will mail the prize to the winner, or the winner can pick up the prize at TEP’s headquarters, 88 E. Broadway Blvd., Tucson, AZ 85701, after making arrangements to do so.
Privacy and Publicity. Any information you provide when you enter the Art Contest will be used in accordance with TEP’s Privacy Policy located at https://www.tep.com/privacy. Except where prohibited, participation in the AI Art Contest constitutes your consent to TEP’s use of your name and/or social media account name, associated images and photos, likeness, biographical information, and statements made by you in connection with the AI Art Contest for any promotional purposes without further payment, consideration, notice or consent.
Your Infringement of Third-Party Intellectual Property Rights. If your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless TEP from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which TEP may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
General Conditions. No purchase is necessary to enter this AI Art Contest. Automated entries are prohibited, and any use of automated devices will cause disqualification. In the event of a dispute as to the owner of an entry, the authorized account holder of the social media account used to enter will be deemed to be the owner. The AI Art Contest is subject to federal, state, and local laws and regulations and is void where prohibited. You acknowledge and agree that TEP, Facebook, Twitter/X and Instagram are not responsible for any failure of the website during the Entry Period, including any technical malfunction of any computer, online systems, servers, access providers, computer equipment, software, failure of any email or review to be received on account of traffic congestion on the internet or on Facebook, Twitter/X or Instagram or any combination thereof including any injury or damage to your or any other person’s computer related to or resulting from downloading any material related to the AI Art Contest, all of which may affect a your ability to participate in the AI Art Contest.
Right to Cancel or Suspend Contest. In the event that the operation, security, or administration of the AI Art Contest is impaired in any way, or circumstances arise out of TEP’s reasonable control which affect its ability to administer the AI Art Contest, TEP may, in its sole discretion, either: (a) suspend the AI Art Contest to address the impairment and then resume the AI Art Contest; or (b) cancel, modify, terminate or suspend the AI Art Contest. In the event the AI Art Contest is terminated, TEP may select the winner from all eligible entries received. TEP reserves the right, in its sole discretion, to disqualify any individual who tampers with the operation of the AI Art Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner.
Release and Limitations of Liability. By entering, you agree to release and hold harmless TEP, Facebook, Twitter/X, Instagram and their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the AI Art Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the AI Art Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the AI Art Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorneys’ fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Governing Law & Jurisdiction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or TEP in connection with the Official Rules shall be governed by and construed in accordance with the internal laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Pima County, Arizona.
